Welcome to NexGen Telecommunication Pvt. Ltd. ("NexGen", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website (nexgentele.com), billing portal (billing.nexgentele.com), services, and any related applications (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms, our Privacy Policy, and any applicable service agreements. If you do not agree, please do not use the Services.
1. Acceptance of Terms
These Terms form a binding contract between you and NexGen Telecommunication Pvt. Ltd., a company registered in Pakistan (Office: Office #1, 1st Floor, NexGen Building, Raffi Park, Qanchi Morr, Sargodha). We may update these Terms at any time; continued use constitutes acceptance of changes. Check this page periodically for updates.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter contracts under Pakistani law (including the Contract Act, 1872). Businesses must be duly registered. By using the Services, you represent that you meet these requirements.
3. Description of Services
- **Internet & Connectivity**: High-speed broadband, fiber optic, and wireless solutions for homes and businesses.
- **Website Development**: Custom web design, development, and hosting (via partners like Hostinger).
- **Security Solutions**: Cybersecurity assessments, compliance tools, and protection protocols.
- **Network Services**: AI-optimized network design, cloud infrastructure, and data analytics.
- **Billing Portal**: Secure access to invoices, payments, and account management via billing.nexgentele.com.
Services are subject to availability, geographic restrictions (primarily Pakistan), and fair usage policies. We reserve the right to modify, suspend, or discontinue Services without notice.
4. User Accounts and Security
- Registration: You must provide accurate information for account creation. You are responsible for maintaining confidentiality of login credentials.
- Billing Portal Access: Use billing.nexgentele.com only for authorized purposes. Sharing credentials is prohibited.
- Security: Report unauthorized access immediately to info@nexgentele.com. We are not liable for losses from compromised accounts.
5. Payments and Billing
- Fees: All prices in Pakistani Rupees (PKR), inclusive of applicable taxes (e.g., GST under the Sales Tax Act, 1990). Payment via bank transfer, JazzCash, EasyPaisa, or cards.
- Billing: Monthly/quarterly cycles; invoices via email or portal. Late payments incur 1.5% monthly Fine.
- Refunds: No refunds for partial service usage; full refunds only for pre-paid unused services within 7 days (subject to inspection).
- Disputes: Resolved per Pakistan's Consumer Protection Act, 2023.
6. Intellectual Property
All content on our sites (text, logos, software) is owned by NexGen or licensors and protected under Pakistani copyright laws (Copyright Ordinance, 1962). You may not reproduce, distribute, or reverse-engineer without permission. We grant a limited, non-exclusive license for personal use.
7. User Conduct and Prohibited Activities
- Comply with all laws, including PTA regulations for telecom.
- Prohibited: Illegal use (e.g., piracy, spam), excessive bandwidth (fair usage: 500GB/month for residential), or interference with Services.
- We monitor for compliance and may terminate access for violations.
8. Disclaimers and Limitation of Liability
Services are provided "as is" without warranties. To the extent permitted by law, NexGen is not liable for indirect, incidental, or consequential damages (e.g., data loss, business interruption). Total liability shall not exceed fees paid in the last 3 months. Force majeure (e.g., outages, natural disasters) excuses performance.
9. Termination
We may suspend/terminate your account for breach, non-payment, or at discretion with 30 days' notice. You may terminate by written notice. Upon termination, outstanding payments are due immediately.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Islamic Republic of Pakistan. Disputes shall be resolved exclusively in the courts of Sargodha, Punjab. We encourage amicable resolution via info@nexgentele.com first.
11. Privacy
Your data is handled per our Privacy Policy (link when added). We comply with Pakistan's Personal Data Protection Act (expected 2025) and international standards.
12. Miscellaneous
- Severability: Invalid provisions do not affect others.
- Assignment: We may assign rights; you may not without consent.
- Entire Agreement: These Terms supersede prior understandings.
